Privacy Policy

This Privacy Policy explains what information NexSpark collects, how we use and protect it, and the choices and rights you have. It works together with our Terms of Service.
1. Who We Are & Scope
NexSpark LLC (“NexSpark”, “we”) operates an AI-assisted, human-reviewed matchmaking service offered to adults (18+) in the United States. This policy covers our website and mobile apps.
2. Information We Collect
- Account & identity: name, email, date of birth, and identity- and age-verification results from our third-party providers, which may include government-ID verification, selfie/liveness checks, and automated age-estimation technology.
- Your answers: your answers across all sections (values, lifestyle, finances, personality, relationship goals, free-text responses), the basis for matching.
- Sensitive (special-category) data, opt-in only: religion/spirituality, political orientation, race/ethnicity, and information about your sex life or sexual orientation. Collected only if you expressly opt in, and used solely to improve matching.
- Payment data: handled by our payment processor; we receive confirmation and limited details but do not store full card numbers.
- Communications: mediated, text-only messages between matched members (moderated for safety), and your messages to support.
- Technical & usage data: device and app information, analytics, and log data, including your IP address (recorded when you sign up and when you sign in) and the approximate, city-level location derived from it. We use this for security, fraud and abuse prevention, and to understand where our members come from. We do not use it to track you across other websites.
- Newsletter signups: if you subscribe to our newsletter, we store your email address, the approximate location (country, region, and city) and the IP address of the signup, and which page it came from. We use this to send the updates you asked for and to understand where interest is coming from. You can unsubscribe from any email at any time.
- What we do NOT collect: we do not access or scrape your social-media accounts, and we use no third-party data-broker enrichment.
3. How We Use Your Information
- To match you: analyse your answers, generate compatibility scores, and create anonymised match reports.
- To verify your identity and age (18+), and reduce fraud and fake accounts.
- To process payments and manage your 12-month term.
- To deliver mediated communications and keep members safe (moderation, abuse prevention).
- To operate, support, and improve the service, including improving our matching models.
- To comply with legal obligations and enforce our Terms.
4. Legal Bases
Where applicable law requires a legal basis, we rely on: your consent (and your explicit consent for sensitive data); performance of our contract with you; our legitimate interests in operating and securing the service; and compliance with legal obligations. You may withdraw consent at any time.
5. AI & Automated Processing
When you save your answers, an AI model converts your free-text answers into structured attributes and generates mathematical representations (embeddings) used for matching. Candidate matches are produced by automated scoring, but a human matchmaker reviews and approves a match before any introduction is delivered, so introductions are not based solely on automated processing. Match reports are scrubbed of identifying details before they are shown.
6. How We Share Information
- Service providers under contract: identity verification, payment processing, cloud hosting, email/communications delivery, content moderation, and analytics. They may use your data only to provide services to us.
- Other members: only after a connection opens, and only the information you choose to share, members remain anonymous to each other until you both choose to reveal more.
- Legal & safety: to comply with law or protect the rights and safety of members and the public.
- Business transfers: in connection with a merger, acquisition, or sale of assets, subject to this policy.
We do not sell your personal information and do not share it for cross-context behavioural advertising.
7. Data Retention & Deletion
We keep your information while your account is active and as needed for the purposes above or as required by law. When you delete your account or withdraw consent, we delete or de-identify your personal data, including derived data such as embeddings, except records we must retain (for example, transaction records, or limited safety/audit logs).
IP addresses and related security logs are kept only as long as needed for security, fraud prevention, and audit, typically no longer than 12 months, and, like all your personal information, are never sold or shared for advertising.
8. Your Privacy Choices & Rights
Depending on where you live, you have some or all of the following rights over your personal information:
- Know and access the personal information we hold about you, and obtain a portable copy.
- Correct inaccurate information and delete your information.
- Withdraw consent at any time, including consent for sensitive (special-category) information such as religion, politics, ethnicity, or sexual orientation.
- Opt out of any “sale” or “sharing” of personal information and of targeted advertising, though NexSpark does not sell or share personal information and does not engage in cross-context behavioral advertising.
- Limit the use of sensitive personal information to what is necessary to provide the service.
- Non-discrimination: we will not deny service, charge a different price, or provide a different quality of service because you exercised a right.
How to exercise your rights. Email privacy@nexspark.com, or use the account controls in the app. We verify your identity before acting and respond within the timeframes required by law. You may use an authorized agent to submit a request on your behalf, with proof of authorization. If we decline a request, you may appeal by replying to our response; where your state provides one, you may also contact your state attorney general.
Your state laws. Residents of California (CCPA/CPRA) and of states such as Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and others with comprehensive privacy laws have these rights under their respective statutes. California residents also have the right to know the categories of information collected and the purposes described throughout this policy.
Global Privacy Control. Where required by law, we honor a Global Privacy Control (GPC) browser signal as a valid request to opt out of sale or sharing, which, again, we do not do.
9. Security
We protect your information with encryption in transit and at rest, access controls, secrets management, identity verification, and regular security review. No system is perfectly secure; we maintain an incident-response process and will notify you and regulators of breaches as required by law.
10. Cookies & Analytics
We use strictly necessary cookies to operate and secure the service, and limited, privacy-respecting analytics (served first-party) to understand usage in aggregate and improve the experience. 11. Children
NexSpark is for adults 18 and older. We do not knowingly collect information from anyone under 18; if we learn we have, we delete it.
12. Data Location
Your data is processed in the United States. NexSpark currently serves US residents only.
