Please read these Terms of Service and Membership Agreement (the “Terms”) carefully. By creating an account or using NexSpark, you agree to these Terms. If you do not agree, please do not use the service.
NexSpark is an AI-assisted, human-reviewed matchmaking and introduction service. You complete a questionnaire; NexSpark analyses it and, when it identifies a strong mutual match, introduces the two members. NexSpark does not offer public profiles, browsing, or search, and members are anonymous to one another until they choose otherwise.
NexSpark is not a background-checking service and does not conduct criminal-history screening unless expressly stated. NexSpark introduces members but does not vouch for, and is not responsible for, the conduct, statements, or safety of any member online or in person. You are solely responsible for your interactions with other members.
To keep the community authentic, NexSpark requires identity and age verification through a third-party provider. You authorise this verification and agree to provide accurate information. Keep your login credentials secure; you are responsible for activity on your account.
Age verification. You are required to enter your date of birth during registration and confirm that you are at least 18 years old. NexSpark may also use third-party age-verification services — such as government-ID verification, selfie/liveness checks, and automated age-estimation technology — especially before allowing messaging, payments, or full account activation. Accounts suspected of belonging to a person under 18 are suspended pending verification, and accounts that cannot be verified as 18 or older will be removed.
Matching is based on the information you provide in your questionnaire. You agree to answer honestly. Certain questions (for example, faith, political orientation, ethnicity, and intimacy) involve sensitive information and are collected only with your explicit opt-in and used to improve matching. NexSpark does not collect data from your social-media accounts. Your information is handled as described in our Privacy Policy.
Introductory period. During a limited introductory launch period, NexSpark is offered free of charge: no connection fee is charged, and connections open on mutual acceptance. NexSpark will give clear notice before any fee takes effect, and you will be able to decline before any charge applies. The fee terms below describe how charges work once the introductory period ends.
One-time fee — not a subscription. The connection fee is a single charge you actively choose to pay when you decide to open a specific connection. NexSpark has no recurring subscription and nothing auto-renews: we will never charge you automatically, and no fee is taken unless and until you choose to proceed. The exact amount and what it covers are shown to you before you pay, and you can decline at no cost.
Three-day right to cancel. You may cancel this agreement, without penalty or obligation, until midnight of the third business day after the date you enter into it, and receive a full refund of any amount paid. To cancel, email hello@nexspark.com before the deadline. Some states give dating-service members additional or longer cancellation and refund rights; where those rights apply, they govern, and nothing in these Terms waives them.
Before a connection opens. If a match is declined, not accepted within five days, or otherwise does not result in an opened connection, no chargeable service has been delivered. The paying member may choose either a 100% refund or an account credit toward future matches.
Consent to immediate delivery. If both members accept and choose to open the connection before the three-day cancellation period ends, you expressly request immediate delivery and acknowledge that, to the extent permitted by law, the connection fee for that delivered match becomes non-refundable once the connection is opened.
After delivery. Once the connection is opened and the cancellation period has passed, the connection fee for that match is non-refundable, except as required by law.
Credits. Account credits apply to future connection fees, are non-transferable, and have no cash value.
Payment of your connection fee begins a 12-month term of best-effort introductions, measured from your first paid match. During the term NexSpark will continue to introduce qualifying matches at no additional connection fee. NexSpark does not guarantee any specific number of introductions, any match, or any relationship outcome. After 12 months your profile remains in the pool on a passive basis, and you may renew active matching.
NexSpark may, in the future, offer an optional Concierge service in which a dedicated human matchmaker hand-curates and manages a member’s introductions alongside the AI for the 12-month term, for an additional fee disclosed at the time it is offered. The Concierge service is not currently available, and nothing in these Terms obligates NexSpark to provide it. If and when it is offered, the cancellation, refund, term, and conduct provisions of these Terms will apply to Concierge members.
You agree not to: misrepresent yourself; harass, threaten, or abuse anyone; solicit money, donations, or commercial dealings; engage in fraud, scams, or unlawful activity; share another member’s information; or use NexSpark for any purpose other than seeking a genuine relationship. Violations may result in content removal, suspension, or termination without refund.
Either member may opt out of a match at any time — before first contact, after messaging, or later — with no penalty. The other member is notified neutrally, and both return to active matching within their term. NexSpark may also pause or close a connection to enforce these Terms or protect members.
NexSpark provides introductions based on the information members supply and the judgment of its systems and staff. It does not warrant the accuracy of any match, the truthfulness of any member, or that any introduction will lead to a relationship.
NexSpark and its software, content, and match reports are owned by NexSpark LLC and protected by law. You receive a limited, personal, non-transferable licence to use the service. You retain rights to the content you submit and grant NexSpark a licence to use it to operate the service.
The service is provided “as is” and “as available,” without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by law, NexSpark’s total liability arising out of or relating to the service will not exceed the fees you paid in the 12 months preceding the claim, and NexSpark will not be liable for indirect, incidental, special, or consequential damages, including any arising from interactions with other members.
You agree to indemnify and hold harmless NexSpark LLC and its officers, employees, and contractors from claims arising out of your use of the service, your interactions with other members, or your breach of these Terms, to the extent permitted by law.
Governing law. These Terms and any dispute arising out of or relating to them or the service are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules — except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions below.
Talk to us first. Most concerns can be resolved quickly. Before starting arbitration, you agree to email hello@nexspark.com describing the dispute and the relief you want, and to give us 30 days to try to resolve it.
Binding individual arbitration. If we can’t resolve a dispute informally, you and NexSpark agree to resolve it through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Arbitration may take place in Atlanta, Georgia, in the county where you live, or by phone, video, or written submission, at your election. The arbitrator decides all issues, except that a court may decide whether this arbitration provision or the class-action waiver is enforceable.
Class-action and jury waiver. Claims may be brought only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated, or representative action. You and NexSpark each waive the right to a jury trial and the right to participate in a class action.
Small-claims option. Either party may instead bring an individual claim in a small-claims court that has jurisdiction.
Your right to opt out. You may opt out of this arbitration agreement by emailing hello@nexspark.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out won’t affect any other part of these Terms.
Nothing here prevents either party from seeking injunctive relief in court to protect intellectual-property or security interests, or limits any right that cannot be waived under applicable law.
